The ABCs of TIFs, DIFs, TIEs, and STAs
Matthew Thomas, Esq.
Tax Increment Finance Agreements (TIFs), Special Tax Assessments (STAs), and Housing Development Tax Increment Exemptions (TIE’s) can be powerful economic development incentives and can help municipalities facilitate investment in their communities, creation of jobs and development of market rate housing. The current COVID-19 Pandemic has caused significant challenges, yet businesses continue to seek opportunities to reposition or expand. These economic development incentives can be powerful tools for communities to grow and retain jobs and to increase their tax base. While the goal of these agreements can be very straightforward, these agreements can be complex and can temporarily impact real estate and personal property tax assessment. The provisions of the General Laws Chapter 23A, which governs TIFs & STAs, were substantially re-written effective August 10, 2016. These changes sought to streamline the TIF & STA process. General Laws Chapter 40V created the Housing Development Incentive Program and Housing Development Tax Increment Exemptions (TIE’s). Matt Thomas has written over 50 Tax Incentive Agreements for municipalities and serves as the Tax Incentives Attorney for one of the largest government tax incentives consultants in Massachusetts. During the presentation Matt will discuss various TIF, STA & TIE provisions, negotiation strategies, and impacts on the tax base and municipal revenue.
